Terms and Conditions for Nassari’s Safaris
Summary
These Terms and Conditions apply to any tours, car rentals and accommodation booked with Nassari’s Safaris a private travel company based in Arusha – Tanzania
These Terms and Conditions govern the contractual relationship between Nassari’s Safaris and yourself. Please read these Terms and Conditions carefully as by booking any tour with Nassari’s Safaris you acknowledge that you have read and understood these Terms and Conditions and you accept and agree to be bound by these Terms and Conditions.
You shall be deemed to have accepted these Terms and Conditions on behalf of all clients named in the booking and therefore all clients in that group indicate their acceptance and agreement to these Terms and Conditions. The client who confirmed the booking is considered to be the selected contact person for all other clients named in that booking.
Confirmation
Booking will be considered confirmed upon receiving from the clients the deposit of 35% of the total travel cost.
Group Booking
If booking for a group, one person should make the booking on behalf of everyone who is going on the tour. The person must be at least 18 years of age when they book the tour. This person must have the agreement of everyone who is going on the tour to make the booking with us and will be responsible for making sure all payments due for the tour are paid in full and at the right time. The person making the booking must fill out our online form or fill out and sign our physical booking form; by doing any of the aforementioned(filling out the online form or filling out and signing the physical booking form) you agree to bind yourself and the group to these booking terms and conditions. The names of every person going on the tour must be filled in the booking form.
When the booking form is submitted with the deposit or full payment, we will confirm the tour provided we are able to do so.
Individual Booking
If booking for yourself, you must fill out our online form or fill out and sign our physical booking form; by doing any of the aforementioned (filling out the online form or filling out and signing the physical booking form) you agree to bind yourself to these booking terms and conditions.
When the booking form is submitted with the deposit or full payment we will confirm the tour, provided we are able to do so.
Terms of payment
A deposit of 35% of the tour cost is required at the time of confirming the booking and the balance not later than 50 days before the commencement of the safari tour. Payment in full is required where bookings are made less than 40 days before the tour begins. Notwithstanding any prior confirmation of arrangements, the right is reserved not to execute tours if payment has not been received in accordance with the foregoing.
In case the date of payment is exceeded, you will receive a friendly reminder. If we still do not receive your payment subsequently, we have the right to cancel your trip and we will charge you cancellation fees of 30% of the total amount.
Cancellation policy
If the client leaves the trip under for any reason, after the trip has begun there will be no refunds and any additional costs incurred due to such action is the sole responsibility of the client.
The client should bear in mind and be aware that cancellation policies and refund depends on the booked activities. The hotel/lodges, camping wildlife safaris, mountain climbing attracts cancellation fees according to their policies.
Cancellation of cultural tours, bike tours, walking safaris, canoeing, coffee tours and town tours does not attract any cancellation fees
In case you may need to cancel your trip please notify us by email as your earliest convenience. Any cancellations shall be effective on the date that we received your cancellation request. The following cancellation fees apply:
- Cancellation up to 50 days before the day of arrival: 30% of the total amount.
- Cancellation from 50 days to 40 days before the day of arrival: 75% of the total amount.
- Cancellation from 40 days to the day of arrival: 100% of the total amount.
No refunds will be given for any unused services, late arrivals or no-shows.
Amendments
All suggested safari itineraries are subject to availability and not guaranteed until confirmed. In case the proposed accommodation is fully booked we will offer you a suitable alternative in the same price range or higher (a surcharge may be applicable). In the unlikely event that the alternative available travel services are not acceptable to you, we will provide a full refund. Especially in the peak season (July August and mid-end December) we strongly recommend booking well in advance to avoid possible disappointment.
Nassari’s Safaris reserves the right to amend and re-adjust the itinerary, transportation, accommodation, and services indicated in the safari program in the event of unforeseen circumstances beyond our control. Any changes will be communicated as early as possible.
Travel Insurance
Comprehensive travel insurance is mandatory and we recommend you to insure for cancellation as well. If you already have travel insurance we strongly advise you to check your coverage. Note that Nassari’s Safaris will make the necessary ground service arrangements, but cannot book your international flight.
Medical Conditions
Clients are responsible for assessing their own suitability and capability to participate a tour with us. All clients should consult their physician regarding their fitness for taking part in the booked tour. Nassari’s Safaris commends all clients to seek their physician’s advice regarding necessary or advisable vaccinations, medical precautions, or other medical concerns regarding the entirety of the client’s travel with Nassari’s Safaris. Nassari’s Safaris does not provide medical advice and also not medical experts. Where you do not do so and are either not allowed to enter any country or suffer personal injury as a result, we have no liability to you for any loss or damage which you suffer.
Acceptance of Risk
You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However it is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.
Optional Activities
Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider.
Marketing
Nassari’s Safaris reserves the right to use any photographs and videos taken during tours for marketing or any other advertising material. The client hereby gives consent to use such photographs and authorizes Nassari’s Safaris to retain copyright for these photographs and such material.
Your Details
In order for us to confirm your travel arrangements you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements.
Transportation
Every effort is made to ensure that the safari vehicles are provided in a roadworthy condition but no liability can be accepted for a puncture, breakdown, damage, or delay as a result of the poor road conditions.
Tour Leaders’ Responsibility
The tour leader who completes the booking form for and on behalf of a group will be responsible for passing on, all information, schedule changes or any other information to the group. If the group leader does not accept this responsibility, every member is required to complete and sign the booking form with his/her relevant contact details.
Delays
Nassari’s Safaris shall not be liable for any claims or if any additional expenses incurred through delays, accidents, or disruption of planned itineraries beyond the control (e.g. flight delays, wars, strikes, weather, act of God, etc), and such expenses (e.g. hotels, meals, telephone calls, flight tickets etc.) are to be borne by the client.
Unscheduled Extensions
In the unlikely event of there being an unscheduled extension to the tour, it is understood that expenses relating to these unscheduled extensions will be borne by the client.
Wildlife in Tanzania
It is a privilege to see animals in their natural habitat and as such, we cannot guarantee wildlife or game viewing. You must take caution when viewing the animals, keep a minimum distance, and carefully follow the instructions given by either the tour guide or wildlife rangers.
Complaints
Any complaints must be reported immediately to the Nassari’s Safaris guide (or head office) and to the supplier of the service, who will do their best to resolve the matter. If the problem is not solved to your satisfaction, the complaint should be reported in writing and not later than 30 days after the completion of the tour. Liability for complaints not notified in accordance with the above-described procedure cannot be accepted.
Liability
Whilst Nassari’s Safaris will exercise utmost care in dealing with you as our esteemed guest and your belongings, we cannot be responsible for loss or damage to personal belongings, personal injury, or death. It is therefore mandatory to have comprehensive travel insurance when traveling.
Force Majeure
If Nassari’s Safaris is affected by force majeure, which means any circumstances beyond the control of the company (including and without limitation, explosions, floods, tempests, fires, accidents, war or threat of war, sabotage, insurrection, civil disturbance or requisition, sickness, quarantine, government intervention, weather conditions or other outwards occurrences, we shall inform you immediately of the nature and extend thereof. The company is not allowed to violate or abuse these conditions.
Payment of any refund to you as a result of the non-performance of any company, we shall use reasonable efforts to compensate you where possible. However, we will be entitled to deduct from any refund recoverable to the reasonable actual and potential costs to the company of the force majeure.
Park Fees, Government Charges and Accommodation Rates
Park fees, government taxes and accommodation rates are determined by relevant authorities and lodging providers may occasionally change due to circumstances beyond our control. Such changes may result from amendments in government regulations, park authority policies, tax structures, currency fluctuations, or hotel and lodge pricing policies. Please note that seasonal variations may also apply, with higher rates during peak or high season and reduced rates during low season. In the event of any increase in the above-mentioned fees or charges after booking has been confirmed, the Company reserves the right to adjust the total safari price accordingly and the Client shall be responsible for paying any such increase.
Flexibility
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
Privacy
Any personal information that we collect about you may be used for any purpose associated with the operation of a Trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the Trip. We will otherwise treat your details in privacy manner. We are committed to conducting our business with high degree of integrity in order to ensure that the confidentiality of personal information is protected and maintained.
Governing Law
These booking terms and conditions will be governed by and constructed in accordance with the law of Tanzania. Accordingly, each party irrevocably submits to the jurisdiction of the Tanzania courts to settle any dispute or matter arising under this contract.
